These Terms & Conditions govern your use of the ExcessiaLuxe website, online store, content, products and related services (“Services”). By accessing or using the Services, you agree to these Terms.

1. ABOUT EXCESSIALUXE

ExcessiaLuxe is an online retail store operated by ExcessiaLuxe with its business/registered address at Haria Dream Park E1 302 Mira Bhayandar Road, Mira Road, Thane 401107. Contact: contact@excessialuxe.com.

2. ELIGIBILITY

You must be legally capable of entering into a binding contract under applicable Indian law to place an order. Where a person uses the Services on behalf of another person or entity, they represent that they have authority to do so.

3. PRODUCTS AND INFORMATION

We aim to present product descriptions, photographs, specifications, colours, availability and prices accurately. Screen settings and supplier information may cause reasonable variations. Product images may be illustrative. We may correct errors, update information or discontinue products, subject to applicable consumer law.

4. ORDERS

An order placed through the website is an offer to purchase. We may accept or decline an order for legitimate reasons including stock unavailability, pricing or listing errors, suspected fraud, payment failure, delivery restrictions or legal requirements. An order is confirmed when we communicate acceptance or dispatch, as applicable.

5. PRICING, TAXES AND PAYMENT

Prices displayed at checkout will govern the transaction, subject to correction of obvious errors before acceptance. Applicable taxes, delivery charges and other charges will be disclosed as required before the order is completed. Payments are processed through Shopify and/or authorised payment providers. Never send passwords, OTPs, PINs or CVVs to ExcessiaLuxe by email or messaging.

6. SHIPPING AND DELIVERY

Shipping estimates are provided in accordance with our Shipping Policy. Delivery dates are estimates unless expressly guaranteed. Delays may occur due to logistics, weather, public events, incorrect addresses, supplier issues or circumstances outside reasonable control. Your statutory consumer rights remain unaffected.

7. CANCELLATIONS, RETURNS AND REFUNDS

Cancellations, returns, replacements and refunds are governed by our Cancellation, Return & Refund Policy and applicable Indian consumer law. Nothing in these Terms excludes rights that cannot lawfully be excluded.

8. ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for information supplied through your account. Notify us promptly if you reasonably suspect unauthorised access.

9. ACCEPTABLE USE

You must not use the Services unlawfully; attempt to compromise website security; introduce malicious code; impersonate another person; interfere with the Services; scrape or exploit the website contrary to law or our rights; or use the Services to commit fraud.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, the ExcessiaLuxe name, branding, website design, original text, graphics and other proprietary content are owned by or licensed to us. Third-party trademarks remain the property of their respective owners. No licence is granted except the limited right to use the website for lawful personal shopping.

11. THIRD-PARTY SERVICES

The store may use or link to Shopify, payment providers, logistics providers, social platforms and other third-party services. Their own terms and privacy practices may apply when you use their services.

12. REVIEWS AND USER CONTENT

Where reviews or other content may be submitted, you must provide lawful content and must not submit defamatory, deceptive, infringing, abusive or unlawful material. You grant us a non-exclusive right to display and use content you voluntarily submit for the purpose for which it was provided, subject to applicable law.

13. DISCLAIMER AND LIABILITY

We do not exclude or limit liability where doing so would be unlawful. Subject to applicable law, we are not responsible for indirect losses arising from events outside our reasonable control or misuse of the Services. Product-specific warranties, if any, are those expressly provided by ExcessiaLuxe, the manufacturer or supplier.

14. PRIVACY

Personal data is handled in accordance with our Privacy Policy and applicable Indian data-protection requirements.

16. GOVERNING LAW

These Terms are governed by the laws of India. Courts and consumer dispute redressal authorities having jurisdiction under applicable law may hear disputes. Nothing here restricts a consumer from approaching a forum available under applicable law.

17. CHANGES

We may update these Terms to reflect changes in our Services, operations or applicable law. The revised Terms will be posted with an updated date.
